Organizer

The organizer of the competition is MAHLE Aftermarket GmbH, Pragstraße 26 - 46, 70376 Stuttgart, Germany (hereinafter referred to as the "Organizer" or "MAHLE").

 

The Sweepstakes is not affiliated with Facebook (FB) and is in no way sponsored, endorsed or organized by Facebook. All inquiries and notices regarding the Sweepstakes should be directed to MAHLE and not to Facebook.

Acknowledgement of the conditions of participation

By participating in the sweepstakes, the participant accepts these conditions of participation. On the channels that provide information about the sweepstakes and call for participation, reference is made to these conditions of participation by providing a corresponding link.

Eligibility

Only persons who have reached the age of 18 and are resident in Europe are eligible to participate. Participation in the sweepstakes is only possible in one's own name.

 

Employees of the organizer, their family members, and all employees of companies of the MAHLE Group, service providers, or cooperation partners who are or were involved in the creation or processing of the sweepstakes, as well as their family members, are excluded from participation.

Each participant may enter the sweepstakes a maximum of once. The organizer reserves the right to exclude participants from the sweepstakes who have demonstrably entered or attempted to enter the sweepstakes multiple times.

 

Manipulation, participation via sweepstakes clubs and automated entries by means of sweepstakes robots are not permitted and will lead to exclusion.

 

In the event of a lack of eligibility, the prize can also be subsequently revoked and a substitute winner determined.

 

The determination of whether an entry is eligible is the responsibility of the organizer.

Runtime, prize and prize processing

The sweepstakes starts on September 01, 2023 and ends on October 24, 2023.

 

The prize includes an Apple iPhone 14 Pro worth €1,299.

Travel, and accommodation costs for the winners, as well as other incidental costs and personal expenses will not be covered by MAHLE.

 

Everyone who installs the MAHLE MPULSE app on their smartphone during the specified period and completes and submits the contact form in the corresponding article will automatically be entered into the competition and have a chance to win the iPhone 14 Pro. The winner will be drawn from all participants.

 

Winners will be notified of their win via email within one week of being determined and asked for confirmation.

 

If the winners do not confirm their acceptance of the prize within a period of 2 working days with mention of their contact details (surname, first name, address, email address or telephone number), the prize will be forfeited and will now be available to a replacement winner. The winner can also renounce his prize. A new winner will be drawn for both.

 

The prize will be sent to the winner by mail to the address provided in the prize confirmation, but only within Europe. With the posting of the prize at the post office, the risk is transferred to the winner. The organizer is not responsible for delivery damages and loss. The participant is responsible for the correctness of the contact data provided. In the event of incorrect assignment of the prize due to incorrect data, the claim to the prize is void.

A payment of the prize in cash, in kind, its exchange or transfer to other persons is not possible.

Entry modalities

Participation is free, voluntary and independent of the purchase of goods or services. Additional costs may be incurred for the use of data services.

 

Participation in the sweepstakes takes place by installing the MAHLE MPULSE app on the participant's smartphone, filling out the contact form in the launch article in full and submitting it.

Submissions by mail or other means are not permitted and will not be considered in the prize drawing.

 

Participants' comments and submissions must not contain insults, false facts, competition, trademark or copyright infringements. Should third parties nevertheless assert claims for infringement of their rights, the participant shall indemnify the organizer against all claims. By taking part in the competition, each participant undertakes to assume responsibility for any infringements of their rights themselves.

 

The organizer reserves the right to delete comments with prohibited content. Prohibited content includes, but is not limited to, content that is pornographic, glorifies violence, is racist, or is objectionable in any other way. Deletion of comments is at the discretion of the organizer.

Liability

The following exclusions and limitations of liability shall apply to any liability of the organizer for damages, without prejudice to the other legal requirements for claims.

 

The organizer is liable without limitation insofar as the cause of damage is based on intent or gross negligence.

 

Furthermore, the organizer is liable for the slightly negligent breach of essential obligations, the breach of which jeopardizes the achievement of the purpose of the contract, or for the breach of obligations, the fulfillment of which enable the proper implementation of the competition in the first place and on the compliance with which the contractual partners regularly rely. In this case, however, the organizer shall only be liable for the foreseeable damage typical for the contract. The organizer is not liable for the slightly negligent breach of obligations other than those mentioned in the preceding sentences.

 

The above limitations of liability do not apply in the event of injury to life, limb and health, for a defect after assumption of a guarantee for the quality of a product and for fraudulently concealed defects. Liability under the Product Liability Act remains unaffected.

 

To the extent that the liability of the organizer is excluded or limited, this also applies to the personal liability of employees, representatives and agents of the organizer.

Early termination of the competition

The organizer points out that the availability and function of the sweepstakes cannot be guaranteed. The organizer is entitled to terminate the sweepstakes prematurely if its feasibility can no longer be guaranteed for technical and/or legal reasons. Such reasons may include technical problems (errors in hardware and/or software, viruses in the computer system, manipulation, etc.), changes to the terms of use or other decisions. No claims shall arise for the participants due to the premature termination.

Change of the conditions of participation

The organizer expressly reserves the right to change or adapt these conditions of participation at any time, with effect for the future. Participants will be informed about possible changes.

Legal action and severability clause

The legal process with regard to the determination of the winners is excluded. No correspondence will be conducted about the sweepstakes. The competition and the conditions of participation are subject to the laws of the Federal Republic of Germany. The place of jurisdiction is Stuttgart.

 

If any of the aforementioned provisions of these Terms and Conditions of Participation are invalid or contain a gap, the other provisions shall remain unaffected. Ineffective or incomplete provisions will be maintained with an effective content that comes closest to the ineffective content in terms of its meaning.

Data protection

The organizer collects, processes and uses all personal data communicated to the organizer in the context of this sweepstakes exclusively for the purpose of conducting the sweepstakes. The organizer will not disclose this personal data to third parties, with the exception of service companies based in Germany ("commissioned data processors") assisting in the implementation of this sweepstakes.

 

Upon request in writing or communicated in text form, participants may at any time request from the organizer information about which personal data are stored by the organizer, may request their correction as well as deletion and revoke data protection consents.
